Medical Marijuana Certification
Dr. Nikash Patel, MD, a board-certified internist, evaluates patients and, when a qualifying condition is present, certifies them for Florida's Medical Marijuana Use Registry. This is a physician-led medical evaluation, not a quick sign-off, and every visit is confidential.
How Medical Marijuana Works in Florida
Florida does not treat medical marijuana like an ordinary prescription. Because cannabis is a Schedule I substance under federal law, a physician cannot write a conventional prescription for it. Instead, a qualified Florida physician evaluates you and, if you have a qualifying medical condition, enters a certification in the state Medical Marijuana Use Registry. You then apply to the state for a Registry Identification Card and, once approved, purchase products from a state-licensed dispensary.
An important distinction: our role is the medical evaluation and certification. We do not sell or dispense cannabis. All products are purchased from Florida-licensed Medical Marijuana Treatment Centers, the only businesses the state permits to sell medical marijuana.
Important: Legal & Regulatory Status
Please read this before booking.
Marijuana remains a Schedule I controlled substance under federal law. Florida's medical marijuana program operates under state law (Fla. Stat. 381.986) through the Office of Medical Marijuana Use. A physician certification is not a federal prescription, and medical marijuana is not FDA-approved to diagnose, treat, cure, or prevent any disease.
We provide the physician evaluation and, when appropriate, the state Registry certification. We do not sell, supply, or dispense cannabis products. Product selection and purchase happen at state-licensed dispensaries. Certification is never guaranteed; it depends on a qualifying condition and Dr. Patel's medical judgment.
This service is an elective medical evaluation and is not a substitute for your primary or specialty care. If you are in a medical or mental-health emergency, call 911, or call or text 988 for the Suicide & Crisis Lifeline.
Legal Considerations Patients Often Ask About
A Florida medical marijuana card does not change federal law or override every state and workplace rule. Before you certify, it helps to understand a few practical consequences. This is general information, not legal advice, and for your specific situation you should speak with a qualified attorney.
- Firearms: Under current federal law, marijuana use, including state-legal medical use, prohibits a person from buying or possessing a firearm. The federal purchase form (ATF Form 4473) asks about unlawful drug use, and marijuana remains federally illegal.
- Driving: A medical card is not a defense to impaired driving. Driving under the influence of marijuana is illegal in Florida, and you should never drive while impaired.
- Employment: A card does not guarantee protection at work. Many Florida employers may still enforce drug-free workplace policies and drug testing, including for cannabis.
Florida's Qualifying Conditions
Florida law lists specific qualifying conditions. Certification requires a diagnosis of one of them, confirmed during your evaluation:
- Cancer
- Epilepsy
- Glaucoma
- HIV / AIDS
- Post-traumatic stress disorder (PTSD)
- Amyotrophic lateral sclerosis (ALS)
- Crohn's disease
- Parkinson's disease
- Multiple sclerosis (MS)
- A terminal condition diagnosed by a physician other than the certifying physician
- Chronic nonmalignant pain caused by or originating from a qualifying condition
- Medical conditions of the same kind or class as, or comparable to, those listed above
Listing a condition here is not a promise of certification or of any medical benefit. Eligibility is decided case by case, and medical marijuana is not FDA-approved to treat these conditions.
Product Forms Available in Florida
Once you hold a valid Registry card, licensed dispensaries offer medical marijuana in a range of forms. Dr. Patel can help you understand the practical differences and discuss what may suit your situation, though the purchase itself is made at the dispensary.
- Tinctures: liquid drops taken under the tongue for measured dosing.
- Oils and capsules: swallowed for a slower, longer-lasting effect.
- Topicals: creams and balms applied to the skin for a localized approach.
- Troches: dissolvable lozenges for gradual sublingual absorption.
- Flower and vaporization: inhaled forms with a faster onset, where permitted for the patient.
The right form and dose are individual. A conservative, start-low approach is generally sensible, and Dr. Patel will talk through the trade-offs during your visit.
What the Process Looks Like
- Physician Evaluation: A confidential visit with Dr. Patel to review your history, current medications, and whether you have a qualifying condition. Bring relevant records.
- Registry Certification: If you qualify, Dr. Patel enters your certification in the state Medical Marijuana Use Registry, and you then receive your Registry login from the state.
- State ID Card: You apply to the Office of Medical Marijuana Use for your Registry Identification Card, online or by paper application, and pay the state fee.
- Purchase at a Licensed Dispensary: Once your card is approved, you buy your products from a state-licensed Medical Marijuana Treatment Center.
- Follow-Up & Recertification: Florida requires periodic follow-up to maintain an active certification. Dr. Patel will explain the schedule that applies to you.
Who May Be a Candidate
Certification is appropriate only for patients with a genuine qualifying condition, confirmed on evaluation. Medical marijuana is not right for everyone. It generally calls for caution, and often is not appropriate, during pregnancy or breastfeeding, with certain heart or psychiatric conditions, or alongside some medications. Dr. Patel may decline to certify when it is not medically appropriate, and will say so plainly.
Frequently Asked Questions
Do you prescribe medical marijuana?
No. Because cannabis is federally Schedule I, Florida physicians do not write a prescription. Instead, Dr. Patel evaluates you and, if you qualify, enters a certification in the state Medical Marijuana Use Registry, which lets you obtain a state card and purchase from a licensed dispensary.
Do you sell the marijuana products?
No. We provide the physician evaluation and certification only. All products are purchased from state-licensed Medical Marijuana Treatment Centers, which are the only businesses Florida permits to sell medical marijuana.
What conditions qualify in Florida?
Florida lists conditions including cancer, epilepsy, glaucoma, HIV/AIDS, PTSD, ALS, Crohn's disease, Parkinson's disease, MS, terminal conditions, chronic nonmalignant pain from a qualifying condition, and comparable conditions. A diagnosis is confirmed during your evaluation, and certification is never guaranteed.
What forms does it come in?
Licensed Florida dispensaries carry forms such as tinctures, oils, capsules, topicals, troches, and inhaled options like flower and vaporization. Dr. Patel can help you understand the differences, though you buy the product itself at the dispensary.
Is this covered by insurance?
No. The physician evaluation is an elective, self-pay service, and the state also charges its own Registry card fee. We do not publish pricing online; please contact us for a personalized quote.
Is medical marijuana FDA-approved?
No. Medical marijuana is not FDA-approved to diagnose, treat, cure, or prevent any disease. Florida's program operates under state law. Dr. Patel will discuss what is and is not known during your visit.
Does a Florida card affect my gun rights, driving, or job?
It can. Under current federal law, marijuana use, including medical use, prohibits buying or possessing a firearm. A card is not a defense to impaired driving, which is illegal in Florida. And it does not guarantee job protection, as many employers still enforce drug testing. This is general information, not legal advice; speak with an attorney about your situation.
